Terms of Service

Welcome to BootsOnCall. These Terms of Service ("Terms") govern your use of our website (bootsoncall.com), our service request platform, our contractor portal, our SMS messaging program, and all related services (collectively, the "Service") operated by Sunshine Treasure LLC ("BootsOnCall," "we," "us," or "our").
By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What BootsOnCall Is
BootsOnCall is a platform that connects property owners and renters ("Customers") with independent local contractors ("Contractors") for handyman, plumbing, electrical, HVAC, and other home repair services. We are not a contractor ourselves. We do not perform the work. We are a platform that matches Customers with Contractors, facilitates communication, and processes payments.
Contractors on the platform are independent businesses, not employees, agents, or representatives of BootsOnCall or Sunshine Treasure LLC. We vet Contractors at onboarding (verifying license where applicable, insurance, and identity), but we do not supervise, direct, or guarantee the work they perform.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older and have the legal authority to enter into these Terms. If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.
3. The SMS Messaging Program
BootsOnCall SMS Program — Key Information
Program Name: BootsOnCall
Program Description: Two-way SMS communication between BootsOnCall and Customers or Contractors regarding service requests, contractor matching, appointment confirmations, status updates, payment receipts, and conversational support.
Message Frequency: Varies based on the activity of your service request or your status as a Contractor. Typically 3 to 10 messages per active service request; occasional account-related messages.
Message and Data Rates May Apply. Standard message and data rates from your mobile carrier apply to all SMS messages sent and received. BootsOnCall does not charge a fee for SMS messages, but your carrier may.
Help: Reply HELP to any BootsOnCall SMS for support information, or email support@bootsoncall.com.
Opt Out: Reply STOP to any BootsOnCall SMS to unsubscribe from all future messages. Opting out of SMS will affect our ability to communicate with you about active service requests.
Supported Carriers: AT&T, T-Mobile, Verizon Wireless, Sprint, Boost Mobile, U.S. Cellular, MetroPCS, Cricket Wireless, and other major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
Consent to Receive SMS
By providing your phone number through our website, by texting our published business number, or by registering as a Contractor, you expressly consent to receive SMS messages from BootsOnCall, including messages sent using automated technology, related to your service request or your Contractor status. Consent is not a condition of any purchase.
Privacy of SMS Data
Your phone number and SMS content are not sold, rented, or shared with third parties for their own marketing purposes. SMS opt-in data is never shared with third parties for marketing purposes under any circumstances. See our Privacy Policy for details.
4. Service Requests and Bookings
How it works for Customers
Customers submit service requests through our website, by texting our number, or by calling. We use the information provided to match the request with an appropriate Contractor in our network. Once a Contractor accepts the job, we facilitate scheduling and payment.
Pricing and estimates
For some standard jobs, BootsOnCall provides a fixed price upfront. For others, BootsOnCall provides an estimated price range based on the information you provide; the final price is determined after the Contractor inspects the job onsite. The Contractor will provide a written estimate before performing any work that exceeds the original estimate, and you must approve any such overages before the work continues.
Deposits and payment
For most service requests, BootsOnCall collects a deposit at the time of booking, held by our payment processor (Stripe). The deposit is applied to the final invoice. The remaining balance is charged upon job completion. You authorize BootsOnCall to charge your payment method for the deposit at booking, the final balance upon completion, and any approved overages.
Cancellations
You may cancel a service request at any time before the Contractor arrives onsite, in which case the deposit is fully refunded. Once a Contractor has been dispatched and arrived at your property, cancellation may incur a service-call fee equal to the deposit amount, at our discretion based on the circumstances.
No-shows
If you are not present at the agreed-upon time and the Contractor cannot access the work site, a service-call fee may apply. We will attempt to reach you by SMS and phone before assessing this fee.
5. Contractor Relationship
Contractors are independent
Contractors are independent business operators, not employees of BootsOnCall. They control their own schedules, methods of work, tools, and pricing within the bounds of platform rules. BootsOnCall does not supervise, direct, or control the manner in which Contractors perform their work.
What we do verify
Before activating a Contractor on the platform, we verify identity, applicable trade licensure, general liability insurance, and (where applicable) state-required bonds. We do not warranty or guarantee the quality of any individual Contractor's work.
Customer feedback
After every job, Customers may rate the Contractor and provide feedback. Repeated poor performance may result in suspension or removal of a Contractor from the platform.
6. Customer Responsibilities
As a Customer, you agree to:
- Provide accurate information about the work needed, including photos where applicable
- Provide a safe work environment and reasonable access to the work site
- Be present (or arrange access) at the agreed-upon time
- Pay the agreed-upon final price promptly upon job completion
- Not contact Contractors directly for off-platform work for twelve (12) months following a job, in order to maintain the integrity of the platform
7. Contractor Responsibilities
As a Contractor, you agree to:
- Maintain valid licensure and insurance throughout your time on the platform
- Perform work in a professional, timely, and quality-focused manner
- Communicate proactively with Customers about scheduling, estimates, and progress
- Not solicit Customers for off-platform work, and accept platform fees on all work originating from BootsOnCall introductions
- Comply with all applicable laws and regulations governing the work you perform
- Carry your own tools, materials, and vehicle insurance
8. Platform Fees
BootsOnCall charges Contractors a platform fee on each completed job. The fee structure is published on the Contractor portal and is updated from time to time. The Contractor receives the remainder of the final price (typically 70–88% depending on tier and job size) via direct deposit to their connected Stripe account.
Customers do not pay any platform fee directly. The price quoted to the Customer is the final price (subject to approved overages).
9. Disclaimers
The Service is provided "as is"
BootsOnCall provides the Service on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Service or any work performed by Contractors, except as expressly set forth in these Terms.
We are not responsible for Contractor work
While we vet Contractors and respond to quality complaints, BootsOnCall is not responsible for the work performed by Contractors. Any disputes about quality, completeness, or suitability of work should be directed first to the Contractor; if unresolved, contact support@bootsoncall.com and we will assist with mediation.
Limitation of liability
To the maximum extent permitted by law, BootsOnCall and Sunshine Treasure LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits or revenues, arising from your use of the Service. Our total aggregate liability for any claim arising from or related to the Service shall not exceed the greater of (a) the platform fees we received from your transactions in the twelve months preceding the claim, or (b) one hundred dollars ($100).
10. Indemnification
You agree to indemnify and hold BootsOnCall, Sunshine Treasure LLC, and our officers, employees, and agents harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Service, or, if you are a Contractor, the work you perform for Customers introduced through the platform.
11. Dispute Resolution
Informal resolution first
If you have a dispute with BootsOnCall, please first contact us at support@bootsoncall.com so we can try to resolve it informally. Most issues can be resolved this way within a few business days.
Governing law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of laws principles.
Venue
Any legal action arising from or related to these Terms or the Service shall be brought exclusively in the state or federal courts located in Cook County, Illinois, and the parties consent to the personal jurisdiction of those courts.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on this page and updating the "Effective Date" at the top, and where appropriate by sending you an email or SMS notification. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service if you violate these Terms, engage in fraudulent or harmful activity, or for any other reason at our reasonable discretion. Sections 5, 6, 7, 9, 10, and 11 survive termination.
